Illegal body cavity searches alleged in Milwaukee

By Elizabeth Chuck, msnbc.com

Seven officers and a supervisor at the Milwaukee police department have had?their badges taken away?after allegations surfaced?that police have been conducting body cavity searches on suspects with no?authority to do so.

Reports of officers arresting suspects then subjecting them to cavity searches first surfaced in local media in March. On Monday, after getting access to a police report, The Milwaukee Journal Sentinel reported that officers allegedly performed these searches on a routine basis.

One Milwaukee officer, Michael Vagnini, "had a reputation" for forcing suspects he believed had drugs in their body cavities to bend over for him, said defense attorney Alex Cossi, who handled a July 2011 case that alleges Vagnini searched his client and another suspect in the booking room.

"This was not a rogue happenstance. This was a tacit acceptance of strip searches without proper procedures or supervision," Cossi told The Journal Sentinel.

Vagnini found suspected cocaine "between (their) butt cheeks," the police report said.

Strip searches, which Wisconsin state law defines as searching "a detained person's genitals, pubic area, buttock or anus, or a detained female person's breast," can only be performed by a doctor, physician's assistant or registered nurse. The state law requires written permission before a strip search is conducted, unless there's probable cause to believe the suspect is hiding a weapon.

Cossi said his client was not provided with written documents before Vagnini performed the cavity search, which is a strip search involving penetration,?on him. Because?improper tactics were used to find the cocaine, the drug dealing charge against Cossi's client was thrown out, The Journal Sentinel reported.

It's not clear how many allegations of cavity searches the Police Department is facing.?

"A number of people came forward so that we have many more complaints than we certainly started out with," Milwaukee police Chief Edward?Flynn said at a news conference Wednesday on April 11. "Of those complaints, I'd say a significant majority of them are of a very similar nature, which indicates that we have more people to talk to than we initially had."

An improper strip search carries a maximum penalty of 90 days in jail and a fine of up to $1,000, according to Wisconsin law.

Vagnini, six other officers and a supervisor, Sgt. Jason Mucha,?have had their badges and guns taken away while the department investigates the claims.

In March, an alleged victim came forward to speak to NBC's TMJ-4 to talk about his claim, which he said?happened when he was only 15.

'They slammed me on the ground'
Kevin Freeman Jr. told TMJ-4 he and his friends were violated during a traffic stop in December.

"When they searched me they eased their hands right between my butt.??I tried to reach back and soon as I tried to reach back to stop them, they slammed me on the ground," Freeman said.??

It's illegal to conduct a body cavity search outside, where people other than the one conducting the search could see it taking place.

Milwaukee police spokeswoman Anne Schwartz told msnbc.com she could not comment on the matter since it was a pending investigation. Police chief Edward Flynn said in a news conference in March the cavity search complaints go back a couple of years. The department's internal investigation will determine whether searches violated department policy, state law, or both, The Journal Sentinel said.

Improperly conducted body searches can be construed under Wisconsin law as sexual assaults because of their invasive nature. It's not clear how much penetration allegedly occurred during the searches.

John Birdsall, a Milwaukee defense attorney, said that if the claims are true, police are abusing their authority.

"One thing is clear, if they're doing rectal searches in the field, that's just illegal," he told the Journal Sentinel. "Clothes or no clothes, you can't do a body cavity search. They don't have the authority to do that."

Milwaukee County prosecutors have launched a John Doe investigation, in which prosecutors can subpoena documents without public knowledge. The FBI and U.S. Attorney's Office are monitoring the investigation, The Journal Sentinel reported, and could launch an investigation.

Sex offenders fight for right to use Facebook

Registered sex offenders who have been banned from social networking websites are fighting back in the nation's courts, successfully challenging many of the restrictions as infringements on free speech and their right to participate in common online discussions.

The legal battles pit public outrage over sex crimes against cherished guarantees of individual freedom and the far-reaching communication changes brought by Facebook, LinkedIn and dozens of other sites.

"It's going to be really, really hard, I think, to write something that will achieve the state's purpose in protecting children online but not be restrictive enough to be unconstitutional," said Carolyn Atwell-Davis, director of legislative affairs at the Virginia-based National Center for Missing & Exploited Children.

Courts have long allowed states to place restrictions on convicted sex offenders who have completed their sentences, controlling where many of them live and work and requiring them to register with police. But the increasing use of social networks for everyday communication raises new, untested issues. The bans generally forbid offenders to join social networks or chat rooms or use instant-messaging programs ? just a few of the online tools that civil liberties advocates say have become virtually indispensable to free speech.

After hearing challenges, federal judges in two states threw out laws or parts of laws that they deemed too stringent. In Nebraska, the decision allowed sex offenders to join social networks. And in Louisiana, a new law lets offenders use the Internet for shopping, reading news and exchanging email. A case filed against Indiana's law is under review.

Authorities insist the bans address a real problem: the need to protect children from pedophiles who prowl online hangouts visited by kids.

"It's hard to come up with an example of a sexual predator who doesn't use some form of social networking anymore," said Steve DeBrota, an assistant U.S. attorney in Indianapolis who prosecutes child sex crimes.

Ruthann Robson, a professor of constitutional law at the City University of New York, said the bans could eventually be taken up by the Supreme Court if the justices decide there's a constitutional question.

"If we think that the government can curtail sex offenders' rights without any connection to the actual crime, then it could become a blanket prohibition against anyone who is accused of a crime, no matter what the crime is," Robson said.

Supporters of the bans say they target repeat offenders such as a Maryland man charged with extorting a 16-year-old girl Indiana girl to perform sexual acts during video chats. He was free on bond when he was accused of doing the same thing to more underage girls.

Trevor J. Shea, 21, of Mechanicsburg, Md., was sentenced to 33 years in federal prison in January after pleading guilty to seven counts of production of child pornography.

Xavier Von Erck, founder of Perverted Justice Inc., a group devoted to exposing online sexual predators, said it doesn't make sense for judges to let pedophiles troll the Web for more victims but revoke the voting rights of people convicted of lesser crimes. He called that "judicial hypocrisy."

The American Civil Liberties Union of Indiana, which is challenging Indiana's 2008 law, argues that it's unconstitutional to bar sex offenders who are no longer in prison or on probation from using basic online services.

"To broadly prohibit such a large group of persons from ever using these modern forms of communication is just something the First Amendment cannot tolerate," said Ken Falk, legal director of Indiana's ACLU chapter.

The case is scheduled for a court hearing Thursday. The main plaintiff, referred to in the suit only as "John Doe," was convicted on two counts of child exploitation in 2000 and released from prison in 2003, according to federal court documents.

The man cannot send questions to televised debates or comment on news stories on local websites because doing so requires a Facebook account, the ACLU contends. Neither can he communicate with his out-of-state family members using the social network or post his business profile on LinkedIn.

The plaintiff is also forbidden to supervise his teenage son's Internet use or investigate questionable friend requests sent to his child, the ACLU claims.

Prosecutors argue that social networking sites aren't the only forms of communication.

"The fact is that telephones still work. People including registered sex offenders may still congregate, discuss, debate and even demonstrate," Indiana Deputy Attorney General David Arthur wrote in a brief.

Television and radio are still widespread and offer numerous call-in shows. Newspapers still accept letters to the editor, he added.

The ACLU says precedent is on its side. The lawsuit cites a February ruling in Louisiana in which U.S. District Judge Brian Jackson found that the state's prohibition was too broad and "unreasonably restricts many ordinary activities that have become important to everyday life."

Louisiana lawmakers passed a new law this month that more narrowly defines what sites are prohibited. News and government sites, email services and online shopping are excluded from the new rules, as are photo-sharing and instant-messaging systems. The measure takes effect Aug. 1.

But courts continue to wrestle with the issue in Indiana and Nebraska, where a federal judge in 2009 blocked part of a law that included a social networking ban. A second legal challenge by an Omaha-area sex offender is set for trial in July.

"I think policymakers are struggling to come up with the right policy that makes sense," Atwell-Davis said. "There's no silver bullet."

Are You Too Old To Get A Divorce? - The Huffington Post

Deciding to end a marriage is a decision that requires plenty of thought. When we interviewed women for "Love For Grownups: The Garter Brides Guide to Marrying for Life When You Already Have a Life," a lot of them were on their second marriages. We asked why their first marriages failed and were surprised by their answers.
According to the AARP, two-thirds of divorces among people over fifty are initiated by the wife. By the time women become "empty nesters," they're about fifty years old. Today, a 50-year-old woman can expect to live another twenty five to thirty five years.

If you feel your life is unsatisfactory and you are thinking of divorce, here are some things to consider.

Do you and your husband still enjoy each others company? Do you still have fun together? Sometimes "mom and pop" become the main part of a relationship and "husband and wife" disappear. Are there things you and your husband share or are there things you two might want to do together? Will both of you be agreeable to working together to protect the relationship or do you feel it's too late to find something to build on again?

Is your marriage being held together by the children? We realize that divorce is not just the end of the couple -- it reconfigures the family. It doesn't just affect the two of you, it affects the children also.If your home has become a toxic place, you should consider getting a divorce. Spend some time thinking about your own identity. What's important to you personally, not just as a part of the family?

Is sex still an important part of your relationship? Routine? Boring? Non-existent? There is plenty of help available today. It's not the taboo subject it was for our parents' generation -- books, tapes, therapists, hormone therapy, Viagra and other help is available. Check it out.

Are you financially independent? Are you working? Can you return to work? Will you accept alimony? How will this affect your retirement plans?

Will you be able to handle the emotional aspect of divorce? Divorce realigns many things-family alliances, friends, children. Will you be able to handle criticism, prying questions, upset children?

Are you able to live on your own? Even though there are times we all would like to be alone, living alone is a different matter. Loneliness does happen. You also need to understand your financial obligations, like rent, taxes and insurance. That's all part of living alone.

Painful as it is, if you no longer act as a team you have to ask yourself the hard questions. What's keeping you together? Are you holding on to memories of the past or planning for the future? Your future should be something to look forward to.

Ann Blumenthal Jacobs, Patricia Lampl and Tish Rabe are the authors of Love for Grown-ups: The Garter Brides' Guide to Marrying for Life When You've Already Got a Life, a relationship guide for women over 35 on how to find Mr. Right, marry and find life-long happiness. The Garter Brides are a sisterhood of women who got married later in life and wore the same garter at their weddings! They offer tried and true advice on how to have the love and life you want.

Video: Obama, Romney reach out to military members

>>> reaching out for the veteran vote in decision 2012 . earlier today mitt romney tried to connect with military members during an event in colorado. he told the crowd how 4 was touched by vets he met monday and how selflessly they gave themselves to their country.

>> i love the men and women of our armed forces and appreciate their sacrifice for this great nation. they give themselves something bigger than themselves, their country, their family.

>> during the commemorations yesterday, president obama had a special message to veterans especially those to the vietnam war from you kocame home and sometimes denny graded instead of selee greated. it was a national shame, a disgrace. that should have never happened. that's why here today we resolve that it will not happen again.

>> joining me is "the new york times" michael sheer who wrote about the military vote. nice to see you. as we show everybody the new gallup poll out yesterday 58% of vets support mitt romney , 34% obama . neither is military related, i mean in terms of being a veteran. how critical is the veterans' vote in securing that moving into 2012 ?

>> well, i think it's especially critical for obama because this is a president who has probably been more aggressive in his use of the military, you any the bin laden killing but also the use of drones, the pursuit of two wars, i mean so if there's ever a time that a democratic president should in theory be able to grab a bigger slice of those voters which have traditionally been republican voters, if you go back to past campaigns this that is moment. and yet that poll suggests he's got a lot of work to do.

>> president obama made a bold statement yesterday at arlington national cemetery about progress in iraq . take a listen to this.

>> for the first time in nine years, americans are not fighting and dying in iraq . we are winding down the war in afghanistan and our troops will continue to come home.

>> certainly that is a significant accomplishment, michael, on obama 's part, especially combined with the killing of osama bin laden . how can mitt romney compare to someone who has ended a war, has overseen the death of who would be the country's greatest enemy, that of bin laden ? is it like trying to compare apples and oranges ?

>> what mitt romney 's going to try to do is shift the conversation to other areas where he thinks he might be stronger. what you see mitt romney doing is, a, looking at benefits for veteran and ask whether veteran feel satisfied that the kind of things they're getting when they come home is what they need and of course a lot of veteran are dissatisfied, and then the other question is, one of sort of overall funding for the military. i mean you know mitt romney is really pushing hard on this idea that president obama wants to gut the military, wants to cut funding for all branches as part of the debt deal that he made last year, earlier this year. you'll have that conversation that mitt romney thinks that he can win and you know the question is whether those topics will be enough to kind of outweigh the accomplishments that the obama administration will claim.

>> as you talk about that yesterday mitt romney told the audience that he was speaking to that he wouldn't take the path to europe is taking and cut the size of our nation's military. take a listen to that.

>> the others to commit to preserve america as the strongest military in the world second to none with no comparable power anywhere in the world. we choose that course in america not so we win wars but so we can prevent wars.

>> talked about the defense cuts or the spending. this is a nation, we are a nation at war for over ten years now. how big of a platform do you think defense will be in the 2012 campaign and the conversations, the debates?

>> i mean looking i think it's part of it, i think that the -- it all fits in the broader conversation about the economy, the debt, the how much money that the government is spending. i think the obama campaign thinks that one of the things that gives them a stronger ground to stand on is this idea that people have sort of internalized the notion that the spending on wars in afghanistan and iraq over the last ten years has cost this country a lot sat home and kind of making it harder to grow out of the economic recession that we were in. so, i think the obama folks think they have that as an edge. mr. romney thinks that he can press the case that somehow president obama won't be as vigorous and enforcing kind of american interests abroad, and we'll see how that plays out over the course of the campaign.

>> forgetting the vet vote, is it all about their care what they need, going forward for their futures, betterment of their families the best jobs they can, the security that they find at home?

>> yeah. and i tell you that is a real key. and really focused on the men vets. there are female vets as well but the real struggle for obama is how to cut into mitt romney 's lead among men and here's a group if he can convince them that their economic fortunes are better off he might do well. you've seen mitt romney already talk about the economic problems for vets when they come back, having trouble finding a job, that's where he thinks he's going to go.

>> thank you. appreciate it.

Tax Rules That Work ? RETIREMENTGUIDE

I?m not a big fan of rules of thumb in the realm of personal finance, primarily because we are such inherently varied and volatile beings that most scenarios end up being the exception?not the rule.? But at risk of breaking my personal rule not to impose them, you will find five tax-driven directives that I am able to endorse but for a few anomalous circumstances.

In my previous post, I called upon the mantra ?Don?t let the tax tail wag the dog!? and addressed ?5 Tax Myths? that many mistake as rules and asked you to consider renouncing them.? Following are ?5 Tax Rules? you should be able to employ to good effect:

Rule #1: Take Advantage of a 401k or Other Retirement Plan

The most effective way for most people to minimize taxes is through the use of a retirement plan, such as a 401k, 403b, or simple IRA.? These are corporate retirement plans that allow you to make pretax contributions to an account that will grow tax deferred until you take distributions in retirement.? In 2012, an individual can contribute $17,000 to a 401k; if age 50 or over, an additional $5,500 catch-up contribution is allowed.? If you make $66,000 per year and contribute $16,000 to your 401k, your taxable income is reduced to $50,000, and you keep the investment.? After you have parted service from a company and reached age 55, distributions can be taken from a 401k without penalty, but the distribution will be treated as taxable income in the year in which it was taken.

Rule #2: Take Advantage of a Roth IRA

A Traditional IRA functions similarly to a 401k or other corporate retirement plan.? Contributions up to $5,000 ($6,000 if age 50 or older), for those with income under $56,000 for a single individual or $90,000 for a married couple, are deductible and thereby reduce taxable income.? As in a 401k, the growth in a traditional IRA will also be tax deferred, but distributions?in this case, after age 59??are subject to full taxation.? .

A Roth IRA, however, is a different animal.? With a Roth, you do not receive a tax deduction on the front end, but the money grows and is distributed tax free.? You don?t need to get your eyes checked; I did say tax free, and those opportunities are few.? The limitations are that you may only contribute $5,000?if 50 or over, $6,000?and make less than $110,000 for an individual or $173,000 as a married couple to be able to contribute the full amount[i] in 2012.

The argument historically has been that if you are young and in a low tax bracket, you should contribute to a Roth; if you?re older and in a high tax bracket, contribute to a traditional IRA because by the time you take distributions from your Roth IRA, your bracket will likely be lower.? But, I suggest that anyone who is eligible to contribute to a Roth should do so.? The reason I can be so broad is that almost all of us will have the bulk of our retirement savings in vehicles like a 401k?all of which will be taxed upon distribution.? In retirement, if we need income, we?ll be forced to take it from our 401k or Traditional IRA ?buckets? and thereby forced to pay tax on it.

It is beneficial for anyone planning for retirement or financial independence to have at least one bucket from which they can take distributions without paying any tax.

Rule #3: Create a Liquid Investment Account?? ?

A liquid investment account is just a standard individual or joint investment account in which you pay typical taxes.? In this account, if you own income-producing bonds, you?ll pay ordinary income tax? on the interest in the year in which it?s received.? If you own stocks, you don?t pay any taxes on the growth until you sell the stocks, and when you do, you?ll pay capital gains tax on the gain (on any stock held over one year), which is currently 15 percent (with very few exceptions).? If you lose money on stocks, when you sell them you can take a tax loss.? When you prepare your taxes, tax losses can be offset against gains, neutralizing the taxable event.? Dividends from stocks are taxed in the year in which they are received at the dividend rate, which is also currently 15 percent?but possibly not for long.? Mutual funds, which own stocks and bonds inside of them, pass the taxable impact of capital gains and income on to the mutual fund shareholders.

With all this taxation to manage, why would I suggest you maintain a liquid investment account as a tax strategy?? If a portion of your portfolio is focused on investing in stocks, long-term capital gains taxation is preferable to ordinary income tax treatment.? If you invest in a stock in your IRA, it will grow tax deferred, and if you sell it in the future and take a distribution from the IRA, you?ll pay ordinary income tax rates, the highest of which is 35 percent in 2012.

If you bought the same stock in a taxable, liquid investment account, your gains would be deferred until you sell the stock in the future.? When you sell the stock years later, you will hopefully have a capital gain and, based on today?s rate, you?d pay 15 percent on the gain.? If you are in a high tax bracket, the difference between that 35 percent tax in the IRA and 15 percent tax in the liquid investment account is significant.

Rule #4: Do Long-Term Investing for College in a 529 Plan

The 529 college savings plans offer a tax-privileged way to save for college, but this rule comes with a caveat.? From a tax perspective, the 529 functions much like a Roth IRA.? Dollars invested in the plan receive no special federal tax treatment initially (although many states offer a state tax deduction for some contributions), but they grow tax deferred and are distributed?if used for qualifying education expenses?tax free.? The caveat is that one?s time horizon must be fairly long to withstand the volatility of the investment vehicles likely to net a meaningful gain.? My next post will discuss in greater detail the benefits and drawbacks of 529 education plans, but I?ll give you a quick preview: you shouldn?t put ALL of your college savings in 529s, but it?s often wise to utilize them for 50% of your education savings.

Rule #5: Utilize a Health Savings Account

If Health Savings Accounts would?ve been available, understood and adopted much earlier, I honestly believe they could?ve reformed our healthcare payment system without need for actual reform, but I must also mention them for their tax benefit, because the HSA may be the multiuse investment vehicle with the most tax privilege allowed by the IRS.? Whether you?re talking about a 401k, a traditional IRA, or a Roth IRA, the IRS only allows you to get a tax break on one side of the timeline?either your contribution or your distribution is tax privileged, but not both.? The HSA, however, allows both the front and the back end tax break.? Every dollar contributed to an HSA is a deduction.? If your employer contributes, they get the deduction; if you contribute, you get it.? The money grows tax deferred, and if you take a distribution to pay for qualified health expenses, the distribution is tax free!? That?s the best deal on the street.

I?ve created an exercise designed to help you recognize the 5 Tax Myths and ensure you?re taking advantage of the 5 Tax Rules.? Click HERE to find instructions and the free download.

Much of the material in this post was legally stolen from the book I co-authored with best-selling author, Jim Stovall, called The Ultimate Financial Plan: Balancing Money and Life, in which you?ll find more on this particular subject in Chapter Eleven: The Gift of Preparation.

As mentioned, if your income falls below $110,000 (single) or $173,000 (married filing jointly), you may contribute the full $5,000 per person, but there is also a ?phase-out? rule that applies.? So, if you?re single, you may be able to make a partial contribution to a Roth IRA if your AGI is between $110,000 and $125,000 on a proportionate basis.? If your income exceeds $125,000, congratulations?you can?t make a Roth contribution.? For those married filing jointly, the phase out is between $173,000 and $183,000.? As if it wasn?t confusing enough?

Iran, big powers extend talks despite split over sanctions

BAGHDAD (Reuters) - Iran accused world powers on Thursday of creating "a difficult atmosphere" in talks on its atomic energy program, signaling a setback in efforts to reach an agreement that would allay their fears that Iran is secretly trying to develop nuclear bombs.

The nub of the dispute appeared to be Iran's demand for fast relief from economic sanctions as part of any deal for it to stop higher-grade uranium enrichment, a pathway to nuclear arms, whereas Western powers insisted Tehran must first shut down enrichment activities.

But there was no sign of breakdown in the talks, which European Union foreign policy chief Catherine Ashton, acting for the six world powers, and Iranian chief negotiator Saeed Jalili extended well into an unscheduled second day and on into the evening.

Both sides had powerful reasons not to abandon diplomacy. The powers want to head off the danger of a new Middle East war raised by Israeli threats to bomb Iran, while Tehran is scrambling to avert a looming Western ban on its oil exports.

Iranian media close to Tehran's delegation said it was insisting on a "principle of reciprocity" of concessions they said was promised by the powers in preparatory talks in Istanbul last month but missing from their approach in Baghdad.

"What we heard in Istanbul was more interesting," an Iranian delegate who asked not to be named said on Thursday.

"We believe the reason (the powers) are not able to reach a result is America. (They) came to Baghdad without a clear mandate so we think the atmosphere is difficult."

But the official Iranian news agency IRNA said later that "in comparison with the morning, the atmosphere is improving", hinting there would be scope for further, nitty-gritty negotiations even if the Baghdad talks ended inconclusively.

Western diplomats expressed hope on Wednesday that Iran, after years of rejecting any discussions on the nature and extent of its nuclear work, was finally engaging the powers on detailed ways of proving it was peaceful purposes only.

PROPOSALS, COUNTER-PROPOSALS

Atop the wish list in the powers' proposal to Iran is for it to stop enriching uranium to a fissile purity of 20 percent.

That is the nuclear advance most worrying to the West since it clears technical obstacles to reaching 90 percent, or bomb-grade, enrichment. Iran says it will not exceed 20 percent and the material will be made into fuel for a research reactor.

Iranian officials hinted at flexibility on higher-grade enrichment but Iranian media said it would not give away its most potent bargaining chip without significant concessions on sanctions.

The powers also want Iran to send its stockpile of higher-refined uranium abroad and close an underground plant devoted to 20 percent enrichment and largely invulnerable to air strikes.

In return, the United States, Russia, China, France, Britain and Germany have offered fuel to keep Iran's medical isotope reactor running, assistance in nuclear safety and an end to an embargo on spare parts for Iran's ageing civilian aircraft.

Jalili countered with his own five-point package of initiatives on nuclear and non-nuclear cooperation, and called for explicit recognition by the powers of Iran's right to enrich uranium, according to Iranian media.

But Western diplomats said Jalili's package lacked practical details and included elements irrelevant to resolving doubts about the Islamic Republic's nuclear ambitions.

"They are pushing back on enrichment and asking us to engage their plan," another Western diplomat said. "It is pretty tough going, but I don't think anyone ever expected anything else. We are moving forward, we are talking about the substance, we are looking for areas of common ground."

Tehran wants any nuclear deal to spare it from an EU embargo on its oil exports to be phased in fully by July 1. It also wants an end to trade and diplomatic sanctions imposed since 2006.

"The West can forgo further sanctions only if Iran forgoes further progress towards a nuclear weapons capability," said Mark Fitzpatrick, non-proliferation scholar at the International Institute for Strategic Studies and a former senior U.S. official.

This would entail installing no more centrifuges, no more work on advanced models of the enrichment machines, and more intrusive monitoring by U.N. inspectors, he said, outlining the small print Western powers are likely to insist on.

On the contrary, Iran has been putting more nuclear "facts on the ground" to boost its leverage, diplomats familiar with findings of International Atomic Energy Agency inspectors said.

They said a report by the U.N. watchdog due in coming days is expected to show Iran has installed more centrifuges in the underground Fordow site, potentially boosting output capacity of nuclear work that the powers want it to cease.

WORRIES ABOUT WAR

Rising tension over the past year has sent global oil prices upward as the West has broadened sanctions to bar Iran's crude exports and the specter of Middle East war has increased with the threat of possible Israeli strikes on Iran's nuclear installations.

Israel is believed to be the only Middle East country with nuclear weapons but regards Iran's nuclear aspirations as a mortal threat given its calls for the demise of the Jewish state.

Iran, the world's No. 5 oil exporter, says it is enriching uranium only in order to generate electricity to serve the needs of a burgeoning population, and for a medical research reactor.

The Islamic Republic has repeatedly ruled out suspending all enrichment as called for by several U.N. Security Council resolutions, saying nuclear energy is a matter of national sovereignty and pride in technological progress.

Flexible Plastic Electronic Display Company Exits E-Reader Market

By Katharine Sanderson of Nature magazine

Plastic Logic, a technology company that makes flexible organic electronic circuits and displays, has conceded defeat in the e-reader race.

The company, founded in 2000 as a spin-out of the Cavendish Laboratory at Cambridge University, UK, was given a US$200-million financial boost from the state-owned Russian Corporation of Nanotechnologies (Rusnano) in January 2011. The investment was intended, in part, to develop a flexible and robust e-reader to be used in Russian schools.

But on 16 May, Plastic Logic announced that it was abandoning its e-reader plans and closing its development plant in the United States. Instead, the company will try to sell its flexible-display technology to other companies that might want to use it in their own products.

The move comes as no surprise to Jon Melnick, an analyst at Lux Research in Boston who specializes in electronics and innovation. Plastic Logic?s technology was too expensive to compete with other e-reader manufacturers, he says, adding that a robust e-reader that would be safe in the hands of a clumsy child isn?t a viable market. ?At a cost of four or five times what a traditional e-reader costs, it just isn?t worth it. No kid is that clumsy.?

Georgiy Kolpachev, managing director of investments at Rusnano, says that it is disappointing that the market and margins weren't right for Plastic Logic's e-reader, but that ?it?s a reality of life?. Plastic Logic still has a competitive advantage, says Kolpachev, because the company has shown that organic electronic devices can be made on an industrial scale ? in this case in a facility in Dresden, Germany. Rusnano?s investment in Plastic Logic was never just about making an e-reader for Russia, he adds, saying that his company remains committed to the firm.

Indro Mukerjee, who became chief executive of Plastic Logic in September 2011, insists that that this is a positive step. ?The e-reader market is not the place where we need to be,? he says. ?It?s a distraction.? He says that Plastic Logic now needs to focus on developing its organic-electronics technology.

But the company faces tough competition. In March 2012, LG Display of Seoul, South Korea, launched a flexible e-paper product with a backplane made from thin film transistors based on semiconductive inorganic materials. The LG device isn?t rollable or as flexible as a completely organic one such as Plastic Logic?s, which uses non-metallic organic transistors in a backplane. But if anyone can develop a reasonably priced flexible e-reader, it is more likely to be a bigger, more experienced company such as LG, says Melnick.

Mukerjee says that Plastic Logic is in talks with a number of potential partners. He suggests that the company?s technology could be licensed to e-book makers for rugged applications in the military or other harsh environments. Other applications include printing organic transistors to be used in sensors or logic circuits on any surface, says Mukerjee.

John Rogers, a materials scientist at the University of Illinois at Urbana-Champaign, who earlier described Rusnano?s 2011 investment as ?eye-popping?, says that he?s still impressed with Plastic Logic?s technology. ?I still think it?s a very promising technology platform, even if e-readers aren?t a killer app for them,? he says.

Mukerjee echoes Kolpachev's insistence that the time Plastic Logic spent trying to develop an e-reader was not wasted and that the company remains ahead of its competitors.

Melnick disagrees. Other companies, such as Polymer Vision of Eindhoven, the Netherlands, are also developing plastic electronics, and Plastic Logic?s failed foray into producing their own e-reader has left them behind the competition, he says. ?Plastic Logic got a lot of money and just went too far too fast,? he says.

Unsecured loans ccjs: Long term funds to lay off support during the ...

Finance Written by Andrea Fletcher ??Saturday, 19 May 2012 22:07

In order to find a way to deal with the debt, it is not that easy sometimes to grab loan. The lender would demand any collateral against the loan amount. Unsecured loans ccjs are the long term finance to be handled for the varied expenses. Such expenses maybe regular or irregular. Regular expenses may be grocery bills, electricity, water and gas bills, etc.? You may have to pay for the house rent.? Situation may arise suddenly to consolidate the debt, renovate the home, pay for the untimely medical aid and then provide untimely medical aid. Unsecured loans ccjs are the long term finance to lay off support during the fund crisis.

Survey of rates or the quotations are conveniently done through online activity. Rates or the quotations may be available on competitive basis.? It is necessary to read the terms and conditions given in the print. Any hidden cost may be easily traceable through thorough study. Higher interest charges are available for long term finance like unsecured loans ccjs. It would not be a difficult task to find a lender who would offer the loan amount ranging between ?1000 and ?25000. The term for the repayment would not go beyond 10 years. You can pay back the loan amount and the interest charges in monthly installment form.

Suffering from the bad credit history is nothing new for the people with an income of ?1000 withcash loans. Sometimes, the debts are so high that the person feels helpless to gain good credit scores. Situation may be sometimes so adverse that he or she may fall under the influence of any of the bad factors. ?Bad factors may be county court judgments, foreclosures, bankruptcy, missed payments, arrears, etc. Often any lender demands extra paperwork. Method of faxing has been erased from the loan market. One can go online and apply with the specific details. It may be citizenship status, monthly pay and the bank account details. You may not have to pay any processing fee for getting the loan approved. But, if the wrong details are provided, then there is a chance of facing the rejection for the application.

Robin Gibb's 5 essential songs

By Tony Sclafani, msnbc.com contributor

Robin Gibb, who died Sunday,?was never the center of attention in the Bee Gees; the group was, after all, originally formed as a teenage act to showcase the songs and singing of his older brother, Barry. Yet when Robin did take the spotlight, the results were often deeply moving, giving the band some of their biggest early hits and most enduring songs. Here are his five most compelling vocals.

Any list of the top Robin Gibb performances has to start with? ?I Started a Joke,? which was also mainly written by Robin. The song climbed to No. 6 in America in 1968 and features Robin?s vibrato-laden voice at its most effective, driving home the song?s angsty lyrics, which some thought had quasi-religious overtones. Despite the Barry-centric focus of the group, it was a Robin song that gave the band its biggest American hit in the 1960s.

Robin also took most of the lead vocal on another 1968 Top?10 hit with an unconventional lyric, ?I Gotta Get a Message to You,? a song sung from the point of view of someone facing imminent execution. Sure, it might seem a bit overly dramatic now, but remember how compelling it was the first time you heard it?

As the Bee Gees entered the 1970s, their music moved in a more adult contemporary direction. Robin left the group for a while, but returned to take lead on several key album tracks, such as ?Sincere Relation? and ?Remembering.? But his shining moment in this era was the opening verse of ?How Can You Mend a Broken Heart?? It?s not a stretch to say that the way he intoned the song?s wistful opening couplet was a large part of what made the tune the band?s first? No. 1?U.S. hit.

During the Bee Gees? disco period ? from 1975 to 1979 ? Barry?s falsetto almost totally dominated the group?s records. But go to their ?Children of the World? album and you?ll find a Robin-tastic surprise: he takes the lead vocal on the R&B ballad ?Love Me,? which became better known when it scored Yvonne Elliman her first major U.S. hit. (Elliman later hit much bigger with another Bee Gees-penned song, ?If I Can't Have You.?)

Jacques Collet / AFP - Getty Images

The final essential Robin Gibb vocal isn?t even a Bee Gees song. It?s his 1984 Top 40 solo hit ?Boys Do Fall in Love.? The danceable, new wavish number showed that his voice, perhaps more than any of his brothers, had a modern edge that suited itself perfectly to the MTV era.

Messy Facebook debut marks weak day on Wall Street

NEW YORK (Reuters) - Stocks fell on Friday after a sloppy debut by Facebook Inc spoiled hopes that a spectacular open for the most-anticipated stock sale in years would brighten the mood in what has been a gloomy month for equity markets.

Shares of Facebook, the social networking giant, were volatile in the busiest day ever for a trading debut. After early gains of more than 10 percent, Facebook shares fell back to the $38 issue price, ending up just 0.6 percent at $38.23.

It was the Nasdaq's most actively traded stock, with more than 566 million shares traded.

"When Nasdaq started running into some problems early on before Facebook opened - when there was a sense they kept putting it off, putting it off, the market did come under a little bit of pressure because people were getting nervous about it," said Ken Polcari, managing director at ICAP Equities in New York.

The S&P 500 dipped below 1,300, seen as a key support level, for the first time since mid-January. Investors were cautious before leaders of the Group of Eight nations met about the euro zone debt crisis.

After delays in the scheduled start of Facebook trading raised anxiety levels among traders and onlookers outside Nasdaq's headquarters, the stock opened at $42.05, compared with an initial public offering price of $38 a share. It rose as high as $45 before pulling back.

Investors were left in the dark about whether their buy and sell orders on Facebook went through as the Nasdaq did not tell broker/dealers whether opening trades had been executed. Nasdaq did not disseminate execution data until 1:50 p.m. (1750 GMT).

"The fact that there is this much interest in a big capital raise, an event like this is good for the markets overall," said Gordon Charlop, a managing director at Rosenblatt Securities in New York.

The S&P 500 fell for a sixth straight day and recorded its worst week since November on growing concerns that global growth will suffer from the euro zone's problems and signs of a slowing U.S. recovery.

The broad index has dropped 7.3 percent so far in May.

The Dow Jones industrial average <.dji> dropped 73.11 points, or 0.59 percent, to 12,369.38. The Standard & Poor's 500 Index <.spx> lost 9.64 points, or 0.74 percent, to 1,295.22. The Nasdaq Composite Index <.ixic> fell 34.90 points, or 1.24 percent, to 2,778.79.

For the week, the Dow fell 3.5 percent, the S&P 500 declined 4.3 percent and the Nasdaq was down 5.3 percent.

Markets are awaiting the G8 meeting when leaders of the world's major industrial economies convene near Washington this weekend.

They will confront the continuing crisis in the euro zone, including the increasing likelihood of a Greek departure from the bloc.

"Domestically we are kind of in a lull in a sense that we are between Fed periods and earnings, so to try to find direction, one of the things that seems to be jumping up at guys is macro, global. And right now that's not wonderful," said Charlop.

Shares of companies in the online social media sphere declined. LinkedIn fell 5.7 percent to $99.02 and Groupon Inc lost 6.7 percent to $11.70. Zynga plunged 13.4 percent to $7.16 after being halted twice during the session.

Biotechs stumbled, weighed down by an 10.9 percent drop in Sequenom Inc to $4.25 after the company said insurer Coventry Health Care Inc terminated an agreement to provide coverage for a prenatal test for Down Syndrome. The NYSEArca biotech index <.btk> dropped 2.2 percent.

Shares of Foot Locker jumped 8.3 percent to $30.33 after the athletic footwear retailer posted higher-than-expected quarterly results.

Winnebago Industries Inc advanced 1.8 percent to $8.66 after receiving an unsolicited buyout offer from North Street Capital LP, the investment firm of racing car enthusiast Alex Mascioli, valuing the No. 1 U.S. motor home maker at $321.5 million.

Volume was strong with about 8.8 billion shares traded on the New York Stock Exchange, NYSE Amex and Nasdaq, above the daily average of 6.83 billion.

Declining stocks outnumbered advancing ones on the NYSE by 2,297 to 728, while on the Nasdaq, decliners beat advancers 1,791 to 699.
