High court has options on health care law

WASHINGTON (AP) ? The arguments are done and the case has been submitted, as Chief Justice John Roberts says at the end of every Supreme Court argument. Now the justices will wrestle with what to do with President Barack Obama's health care overhaul. They have a range of options, from upholding the law to striking it down in its entirety. The court also could avoid deciding the law's constitutionality at all, although that prospect seems remote after this week's arguments.
A look at six potential outcomes, from the simplest to the most complicated possible rulings:

Q. What if the Supreme Court upholds the law and finds Congress was within its authority to require most people to have health insurance or pay a penalty?
A. A decision in favor of the law would end the legal fight and allow the administration to push forward with implementing its provisions over the next few years, including the insurance requirement, an expansion of Medicaid and a ban on private insurers' denying coverage to people with pre-existing health problems.
The political wrangling, however, probably would continue as candidates for Republican presidential nomination and lesser offices are calling for repeal of the law.

Q. What if, on the other hand, the court strikes down the entire law?
A. That would kill a costly new federal entitlement before it has a chance to take root and develop a constituency of beneficiaries and supporters, namely more than 30 million people who are supposed to wind up with health insurance because of the law.
In addition, some parts of the law already are in effect and would be rolled back. One popular provision allowing young adults to stay on their parents' insurance until age 26 has added nearly 2.5 million people to the coverage rolls, at no cost to taxpayers.
But there's no escaping America's double-barreled problem of excruciatingly high health care costs and many uninsured people, more than 50 million according to the latest estimates.
Whether it's dealing with the federal deficit, retirement security for seniors or even the Pentagon budget, elected officials would still have to confront health care at nearly every turn.
Congress would get to roll the ball up the hill again.

Q. What happens if the court strikes down the individual insurance requirement, but leaves the rest of the Affordable Care Act in place?
A. Knocking out the requirement that Americans carry insurance would not be the end of Obama's health care overhaul. There's a lot more in the 900-plus pages of the law.
But it would make the complicated legislation a lot harder to carry out, risking more complications for a U.S. health care system already seen as wasteful, unaffordable and unable to deliver consistently high quality.
Ten million to 15 million uninsured people who would have gotten coverage under the law could be left out.
The cost of individually purchased private health insurance would jump. That would make it more expensive for the government to subsidize premiums, although millions of middle-class people would still be entitled to such assistance under the law's remaining provisions.
If the individual mandate is struck, the law's Medicaid expansion would still cover millions more low-income people, mainly childless adults.
And a host of other mandates would stay in place. Starting in 2014, medium-sized and large employers would be hit with fines for not providing coverage to their workers.
Insurance companies would be required to accept people with pre-existing medical problems, no longer allowed to cherry-pick the healthy to keep costs down. They would also be barred from imposing higher premiums on people in poor health and limited in what they could charge older adults.
If that happens, premiums in the individual health insurance market would jump anywhere from 10 percent to 30 percent, according to various forecasts from economists.
Experts debate whether or not such a cost spike would trigger the collapse of the insurance market for individuals and small businesses ? or just make coverage even more expensive than it already is.
"Without a mandate the law is a lot less effective," said MIT economist Jonathan Gruber, who advised the Obama administration and, earlier on, then-Massachusetts Gov. Mitt Romney, who put such an insurance mandate in that state's health care law. "The market will not collapse, but it will be a ton more expensive and cover many fewer people."

Q. What if the court strikes down the mandate and invalidates the parts of the law that require insurance companies to cover people regardless of medical problems and that limit what they can charge older people?
A. Many fewer people would get covered, but the health insurance industry would avoid a dire financial hit.
Insurers would be able to continue screening out people with a history of medical problems, such as diabetes patients or cancer survivors.
That would prevent a sudden jump in premiums. But it would leave consumers with no assurance that they can get health insurance when they need it, a major problem the law was intended to fix. Other economically developed countries guarantee health insurance for their citizens.
A related requirement limits premiums charged to older adults. Currently people in their late 50s and early 60s can face premiums as much as six or seven times higher than those charged to 20-year-olds. The law says insurers may charge older adults no more than three times what they charge younger ones.
Administration lawyers say the insurance requirement goes hand in hand with the coverage guarantee and cap on premiums, and have asked the court to get rid of both if it finds the mandate to be unconstitutional.

Q. What happens if the court throws out only the expansion of the Medicaid program?
A. Throwing out the expansion would severely limit the law's impact because roughly half of the more than 30 million people expected to gain health insurance under the law would get it through the expansion of Medicaid, the federal-state health insurance program for low-income people.
The law would effectively bring under Medicaid everyone making up to 138 percent of the federal poverty level. That works out to about $15,400 for an individual, $30,650 for a family of four. Most of those who would be added to the Medicaid rolls are low-income adults without children.
But a potentially sizable number of those low-income people might still be eligible for government-subsidized ? though probably more expensive ? private insurance under other provisions of the law. Private coverage will probably be more expensive for taxpayers to subsidize than Medicaid.
States suing to overturn the federal law argue that the Medicaid expansion comes with so many strings attached it amounts to an unconstitutional power grab by Washington, reaching directly into the wallets of state taxpayers.
The administration counters that the federal government is paying all of the initial cost of the expansion and 90 percent in perpetuity, well above what Washington contributes for regular Medicaid. Moreover, when Congress created Medicaid in 1965 it also served notice on the states that program rules could change in the future. This is only the latest of many such changes.
The Supreme Court took on this issue even though none of the district or appeals courts that heard health care lawsuits had any problem with the Medicaid expansion.
"We don't have any lower court that has struck down this (Medicaid) provision, so there is no precedent from the lower courts on how to handle it," said Diane Rowland, a Medicaid expert with the nonpartisan Kaiser Family Foundation. "They all upheld it."

Q. What happens if the court decides that the constitutional challenge is premature?
A. The wild card, and least conclusive outcome in the case, probably also is the least likely, based on what justices said during the arguments. No justice seemed inclined to take this path, which involves the court's consideration of a technical issue. The federal appeals court in Richmond, Va., held that the challenge to the insurance requirement has to wait until people start paying the penalty for not purchasing insurance. The appeals court said it was bound by the federal Anti-Injunction Act, which is intended to facilitate tax collections and keep the government operating. That law says federal courts may not hear challenges to taxes, or anything that looks like a tax, until after they are paid.
It remains at least possible that if the justices have trouble coming together on any of the other options they could simply decide not to decide the big issues.
Although the administration says it doesn't want this result, such a decision would allow it to continue putting the law in place and force postponement of any subsequent challenge until more of the benefits are being received. On the other hand, Republicans might have more ammunition to press for repeal of the law in the meantime.

STOCKHOLM, March 29 (Reuters) ? Sweden moved to tighten tax
rules for owners of stakes in private equity funds, part of a
push against untaxed profits in the 250 billion crown ($37.5
billion) industry, which is the second biggest in Europe
relative to economic output.
A Finance Ministry proposal aims to tax income of private
equity fund owners, or so called carried interest, primarily at
the income tax rate rather than the capital gains rate which is
lower.
The Finance Ministry said there was a need for greater
clarity in the area which would be beneficial for private equity
in the longer term.
?The uncertainty around how this income should be taxed has
led to a situation which in the future could be harmful for this
kind of economic activity,? the Ministry said on Thursday in a
note accompanying its proposal.
While much of Europe has seen restrained private equity
activity recently, Sweden and the rest of the Nordic region have
been having a bit of a boom as the countries have suffered less
from the sovereign-debt crisis.
But profits made by private equity firms in Sweden, the home
of social democracy, have raised eyebrows.
The government, in the hands of the centre-right but
sensitive to allegations it favours bankers, has already moved
recently to close other private equity tax loopholes after
scandals related to private equity in the tax-funded healthcare
sector.
The latest move against carried interest targets
arrangements which typically entitle private equity partners to
a share of profits from a fund. In much of Europe, carried
interest is treated as capital gains and is subject to lower tax
rates than wages.
The issue hit the spotlight in the United States during the
Republican presidential primaries, when front-runner Mitt
Romney?s low-tax private-equity payouts were castigated by
opponents.
The new Swedish rules include a statute meaning any person
who through a broad range of vehicles, including trusts, owned
stakes in private-equity firms would be taxed on dividends and
profits as if the stake was owned directly by that person.
Dividends and profits by private-equity partners would be
first taxed as income from employment up to a ceiling, after
which the remainder would be taxed as income from capital, at a
lower 30 percent tax rate, the ministry said.
The regulations, which if passed by parliament would come
into force at the turn of the year, cover private equity funds
that acquire, manage and divest shares in unlisted companies and
where their stake at any point amounted to 50 percent or more.
Late last year local media reported that tax authorities had
landed the founder of private equity firm IK Investment Partners
with a tax bill of almost 1 billion crowns ($149.7 million).
The proposal has been sent out for comment to various
government instutions, including the private equity lobby.

The Houston Bar Association?s Elder Law Committee will sponsor a Will-A-Thon to provide simple wills and basic medical directives, free of charge, for elderly citizens who meet the income guidelines.
To apply for assistance through the Will-A-Thon, senior citizens must call 713-228-0735 from 9 a.m. until 3:00 p.m., by April 6, to complete a screening application over the phone. To qualify, applicants must be Harris County residents 60 years of age or older and meet the Houston Volunteer Lawyers Program low-income guidelines.
Those who qualify will be given an appointment to meet with a volunteer attorney on April 17 at the Third Ward Multi-Purpose Center, 3611 Ennis in Houston. The documents will be completed on May 15 at the Third Ward Multi-Purpose Center.
The Houston Bar Association?s Elder Law Committee provides free legal services and advice to senior citizens in Harris County, as well as free handbooks on Elder Law.

This is the most damaging of blacklists. But not only does it block an individual IP address it also blocks the IP addresses adjacent to it. For example if the IP address 192. 156. 66. 67 was added to a comprehensive blacklist in that case all IP addresses close to 192. 156. 66. 67 as well be blocked.

My son gave me a picture of an owl he?d colored in preschool with the word ?Merhaba? written above it.? A scholar from Turkey has been visiting his classroom while on a one year fellowship in early childhood education.
?Merhaba means hello!? I say, hoping he?ll be impressed.
?I already know that!?
Oren, not yet five, is confident about non-English languages.? When his best friend?s? mother spoke Chinese during soccer practice, Oren asked her if she also knew Spanish.
?No, I don?t.? She shrugged.
?Why not? I speak Spanish!?
?I guess you?ll have to teach me.?
?And you can teach me Chinese!?
I can still remember the excitement and awe I felt when I brought my first non-English word home from school to my mother.
?Do you know how the Sioux Indians say hello?? I handed her this grade school question much like I had handed her a yarn covered jar pencil holder and a caterpiller magnet.? Getting older meant I could give her gifts of the mind.
?Hau,? Mother said triumphantly, forming a stop sign with her raised hand.? Although she spoiled my chance to wow her with my new knowledge, I was proud of her Lakota fluency.? When she later greeted some of my grandmother?s neighbors in Spanish, I was overwhelmed with pride.
I learned ?merhaba? ten years ago from my friend Serif who had also had a one year visiting scholar position at my university.
?Incredible! Incredible!? He said when I returned a book to him at his small campus apartment.? I can see him now: one hand raised above his head, the other grabbing a slice of white bread or cup of tea.
After eating a meal in the dining hall, ?incredible!?? After watching the annual town bike races, ?incredible!?
?How was your day?? I asked when I?d run into him at the bus-stop.
?Incredible! Incredible!?
He did not strike me as unusually upbeat or awestruck, so after several months of new friendship I asked, ?How do you say incredible in Turkish??
?Inanilmaz! Inanilmaz!?? The same inflection, the same gestures to the heavens, the same stress pattern and number of syllables.?? From then on when he shouted ?Incredible!? I parroted the word back to him in Turkish.
I packed this one word with me when I visited his family in Turkey the following year. ??I was giving a paper in Spain and it seemed easy enough back then (single and childless) to continue my journey East to see Serif at home, roasting kestane kebap (chestnuts) with his mother on an electric stove, watching his daughter pass out tiny glasses of copper-colored tea.? I couldn?t make out much of what he said to his family but I had no trouble hearing this common interjection. Inanilmaz! wasn?t very useful when they sent me on an errand to buy a loaf of bread (ekmek), but it brought a smile to new Turkish friends? faces.
Oren wasn?t as impressed.
?Inanilmaz, means incredible!? I said, as if I had given him fifty cents for the toy crane machine in the mall.? He?d already clawed something better.
?What I?m learning is mor.? Mor means moth.?
?Moth??
The next day his regular classroom teacher explained, ?They?re learning colors and there was a purple butterfly.? Mor means purple in Turkish, that?s where he probably got that from.?
Turkish has an unimpressive rank among the world?s most commonly spoken languages (between 20 and 30). There are few Turkish speakers in our town; no Turkish restaurants, no Turkish cartoons, and I can?t think of a single Turkish actor.? However, in our university town, we can regularly find a handful of Turkish academics and this year one has decided to teach in the campus pre-school class. While learning more commonly spoken and/or highly valued world languages (e.g. Spanish, French, Chinese, Arabic) may feel more vital for Oren?s future in the ?linguistic marketplace,? the reality is that in the United States few children learn the importance of any language relative to English. While speakers of world languages struggle to acquire fluency in English, monolingual Americans relax in the clouds, much like Jack in the Beanstalk?s Giant, mindless of his golden egg-laying goose.

Oren has just started making connections between spoken and written English, asking to title pictures and to ?make books,? cutting images of animals out of the New Yorker, taping them to the inside of a folded piece of colored paper and dictating sentences for each ?page.? Why not add another skill in early childhood, to learn to say the ?same thing? differently in non-English languages, and to use context cues to make sense of differently patterned sounds and syllables.

When I left his classroom, another child and his mother were counting the school steps in Spanish.

?Oh we don?t speak any Spanish,? the mother apologized.? ?We only know to count from one to ten.?
While my question seemed to have blown an adult fuse, I perceived a flicker of understanding from her son.? He knew the exclamation of praise and the upward inflection of a question.? While he might have remained silent or mistakenly answered ?Purple!? or ?Moth!? I could sense he captured the rhythm of adult-child turn-taking.

Filing six cases against Apple, Samsung, RIM, HTC, Sony and LG, the lawsuits reference floating point calculations for rendering graphics, something that the company received patent approval for only yesterday. GPH claims that several phones, including the iPhone, Galaxy S II and BlackBerry Torch, infringe on its intellectual property.
